Probate Judges Caught In Legal Back-and-forth Over Same Sex Marital Relationship

BIRMINGHAM, Ala. (WIAT) — — It appears that 68 probate judges in Alabama have stopped releasing marriage licenses to same sex couples, according to the Person Rights Project.

The stop comes after the Alabama Supreme Court released a 148 page judgment banning those judges from releasing licenses to gay couples.

Before the order last night from our state’s Supreme Court, a bulk of Alabama probate judges were on the best side of history and doing the best thing and following a federal order, said Ben Cooper with Equality Alabama. Fans of same sex marital relationship say this fight harms loving households who desire the security granted to straight couples.

It has been nothing less than confusion and chaotic for the citizens right here, stated Cooper.

That is a result from our state Supreme Court and our chief justice, he continued. Caught in the middle are probate judges. Each analyzes the law as they see it. Now, their hands are tied.

It has actually been a tough thing to deal with and we have actually tried to be constant with exactly what we seemed like the law was, stated Tuscaloosa County Probate Judge Hardy McCollum. He states the concern surrounding marital relationship licenses comes down to requirements.
